These terms are an agreement between you and Ziv Mizrahi, an independent developer publishing as Nice Try apps ("we", "us"), about your use of the Gingerbread Gambit: RPS app on Android and iOS (the "Game") and this website. By installing or playing the Game you accept them. If you do not agree, please do not use the Game.
The short version. Play fair and be kind. Coins, gems and cosmetics are part of the game, not money, and they cannot be cashed out. Purchases are handled by Google Play or the App Store and follow their refund rules. Battle Pass progress resets every season. You can delete your account whenever you like. The rest of this page is the detail, and the detail is what counts.
1. Who can play
The Game is intended for a general audience aged 13 and over. If you are under the age of majority where you live, you may use the Game only with the involvement of a parent or guardian, who accepts these terms on your behalf and is responsible for any purchases made on your device.
2. Your licence to play
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Game on devices you own or control, for your own non-commercial entertainment, in line with these terms and the rules of the store you got it from.
You may not copy, modify, decompile, reverse engineer or redistribute the Game, except where the law expressly allows it despite this restriction; run automated or modified clients; or use the Game to build a competing product.
3. Accounts
- You can play as a guest, or sign in with Google or Apple. Guest progress is tied to the device and can be lost if you uninstall or change devices before signing in.
- You are responsible for activity on your account and for keeping your Google or Apple sign-in secure.
- Display names must not impersonate anyone or be offensive, hateful, sexual, or infringe anyone's rights. Names are filtered automatically and we may reset or refuse a name.
- You can delete your account at any time from Profile → Delete Account. Deletion is permanent; see what is deleted.
4. Virtual currency and items
The Game contains virtual currencies (coins and gems) and virtual items (such as skins, board themes, emotes, bundles and Battle Pass rewards), together "Virtual Items".
- Virtual Items have no monetary value. They are a limited licence to use a feature of the Game, not property you own. They cannot be exchanged for real money, goods or anything of value outside the Game, and cannot be sold, traded or transferred to another account.
- All shop items are cosmetic. They do not change the rules of a match or give a competitive advantage.
- Balances and ownership are recorded on our servers against your account, which is what lets them move with you between devices when you are signed in.
- We may adjust prices, rewards and the availability of Virtual Items, for example when rebalancing the economy. We will not take away a Virtual Item you have already paid real money for, except as described in section 11 or if the Game is discontinued.
- Virtual Items obtained through a bug, exploit, refund abuse or any unauthorised method may be removed.
5. Purchases and refunds
- Real-money purchases are processed by Google Play on Android and the Apple App Store on iOS, under their terms. We never receive your payment details.
- Prices are shown in the store before you confirm and include any taxes the store collects.
- A purchase is delivered to the account you are signed into at the time. If something you bought does not arrive, use Settings → Restore Purchases, then contact us.
- Refunds are handled by the store. Request one through Google Play or Apple, under their refund policies. Because Virtual Items are delivered immediately, where the law allows it you agree that your right to withdraw ends once the item is delivered. Nothing in these terms limits refund or consumer rights you have by law.
- If a purchase is refunded or charged back, the Virtual Items it granted may be removed from your account.
- Remove Ads removes interstitial ads permanently for the account that bought it. Optional rewarded ads stay available because you choose to watch them.
6. Battle Pass seasons
The Battle Pass runs in seasons of a fixed length, shown in the Game.
- At the end of each season, Battle Pass XP, claimed tiers and the premium pass reset for the new season.
- Rewards you have not claimed before the season ends are lost. The Game warns you when a season is close to ending and you have rewards waiting.
- A premium pass bought in the last days of a season also covers the following season, as described in the Game at the time of purchase.
- Rewards you have claimed, such as cosmetics and currency, stay with you after the season ends.
7. Ads
The Game shows ads served by Google AdMob: optional rewarded videos you choose to watch for in-game rewards, and occasional interstitial ads between matches. Ads come from third parties and we do not control their content, although ad content is limited to a teen-appropriate rating. How ad data is handled is set out in the privacy policy.
8. Fair play and conduct
You agree not to:
- cheat, use bots, modified clients or any tool that automates play or reveals hidden information;
- exploit bugs, or manipulate matchmaking, rankings, rewards or purchases, including deliberately losing matches or colluding with an opponent;
- harass, threaten or abuse other players, including through display names or emotes;
- interfere with or overload our servers, or try to access accounts or data that are not yours;
- sell, buy or share accounts.
Online matches are verified on our servers, and moves that no fair client could have made are rejected. If you find a bug, please tell us instead of using it.
9. Online play and availability
Online matches, leaderboards, purchases and saved progress depend on internet access and on services that may occasionally be down. We work to keep the Game running but do not promise it will always be available, error-free, or that any particular feature or mode will continue to exist. Offline modes (VS AI, Campaign and Pass & Play) do not need an opponent online.
We may update the Game, and some updates may be required to keep playing online.
10. Ownership
The Game, including its code, artwork, characters, music, sounds and text, and the names "Gingerbread Gambit" and "Nice Try apps", belong to us or our licensors and are protected by intellectual-property laws. These terms do not give you any rights in them beyond the licence in section 2.
If you send us feedback or ideas, we may use them without obligation to you.
11. Suspension and termination
We may suspend or close an account, reset its progress, or remove Virtual Items if it breaches these terms, for example through cheating, exploits, fraud or abuse of other players. Where it is reasonable, we will tell you why. You may stop using the Game and delete your account at any time.
If we ever discontinue the Game, we will give reasonable notice in the Game or on this website where we can.
12. Disclaimers and limitation of liability
The Game is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential loss, or for loss of data, Virtual Items or profits, arising from your use of the Game. Our total liability for any claim relating to the Game is limited to the amount you paid us through in-app purchases in the 12 months before the claim.
Some jurisdictions do not allow these exclusions or limits, so they may not all apply to you. Nothing in these terms excludes liability that cannot be excluded by law, or affects your statutory rights as a consumer.
13. Extra terms for the iOS version
If you got the Game from the Apple App Store, the following also apply:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for the Game and its content.
- Your licence is limited to use on Apple-branded products you own or control, as permitted by the Usage Rules in the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to the Game, including product-liability claims, claims that it fails to conform to legal or regulatory requirements, consumer-protection claims, and claims that it infringes a third party's intellectual property.
- You confirm that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting", and are not on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
14. Changes, governing law and contact
Changes. We may update these terms. The date at the top shows the latest version. For material changes we will give notice in the Game or on this website before they take effect. Continuing to play after that means you accept the updated terms.
Governing law. These terms are governed by the laws of the State of Israel. A claim may be brought in any court that has jurisdiction under Israeli law. If you are a consumer living outside Israel, you also keep the protection of the mandatory consumer laws of the country where you live and may bring a claim in its courts.
Severability. If any part of these terms is found unenforceable, the rest stays in effect.
